COURSE OVERVIEW

A commercial lawyer is essentially called to balance not only a legal risk, but a business and commercial risk. Whereas the commercial contracts are the siege where liability limitations, risk mitigation and the overall obligations are enshrined, a commercial lawyer should be well accustomed to the anticipated risks of litigation and should be able to project the application of that contract to the business relationship per se.

For this, both the substantive and procedural laws need to be well taken into consideration in order to insure a genuine limitation of liability, protection rests, as well as a correct management of that contract. Whereas the UAE Law provides the regulatory tools in this respect, this discussion aims at exploring and explaining them, to support the practitioner to a better and more valuable advice to the client.
