ABOUT THE LAWS OF THE DIFC SERIES

In 2016 the Laws of the DIFC series were launched to provide a narrative statement of the Laws of the DIFC on a subject-by-subject basis in a similar way to the famous Halsbury’s Laws of England. The series are designed to ensure those who are familiar with other common law jurisdictions, but not the DIFC, can quickly establish where they can rely on their existing understanding of the Common Law. In addition, it will also help those who regularly work in the DIFC have easy access to the latest legal position. Since then, four volumes have been issued.

Since then four volumes have been issued. These books provide:

  • A background and explanation as to why each law was issued;
  • Information on the specific international laws which inspired the law with the differences and similarities between those laws highlighted;
  • Information on cross overs with other DIFC Laws and the impact of relevant regulations (which are provided in the appendices).
  • Provision by provision analysis including details of relevant DIFC and Common law cases.
  • Clarifications on the meaning of the provisions
  • Useful further reading for particular provisions including relevant Halsbury’s references.
  • The author’s experience of how the provisions of DIFC Laws operate in practice.

Volume 2 (Reissue):

The Laws of the DIFC – Volume 2, is the second commentary in a series of four commentaries, commissioned by the DIFC on the laws in this jurisdiction.

Each book covers a number of specific laws on a provision by provision basis – explaining their origins and aims, similarities and differences to equivalent international legislation which has influenced these laws and the interpretation of the area in relevant DIFC and common law case law.

This is the second edition of Volume 2 – and has been updated to reflect changes in legislation and case law since the original edition was issued in 2017.

This volume covers the Contract Law, DIFC Law No. 6/2004 and the Implied Terms in Contracts and Unfair Terms Law, DIFC No. 6/2005 laws which have been discussed in new relevant cases since this Volume 2 was first issued.

In addition, it covers the Real Property Law and Data Protection Law, where the legislation has been replaced by DIFC Law No. 10/2018 and DIFC Law No. 5/2020 respectively, since our first edition.

It also covers changes to the Strata Law DIFC Law No. 5/2007 as a result of amendments brought in by DIFC Law No. 11/2018 and to the Trust Law which has been replaced and amended since our last edition.

More information equivalent legislation and relevant case law has also been added to the coverage of the final law in this Volume Electronic Transactions Law, DIFC Law No. 2/2017.

 

Volume 3 (Reissue):

The Laws of the DIFC – Volume 3, is the third commentary in a series of four commentaries, commissioned by the DIFC on the laws in this jurisdiction.

Each book covers a number of specific laws on a provision by provision basis – explaining their origins and aims, similarities and differences to equivalent international legislation which has influenced these laws and the interpretation of the area in relevant DIFC and common law case law.

This is the second edition of Volume 3 and contains coverage of two new laws: the DIFC Limited Partnership Law and DIFC General Partnership Law, as well as an update on the DIFC Limited Liability Partnership Law.

Since the last edition, the DIFC Operating Law, which is covered in the Laws of the DIFC, Volume 4, has been issued, bringing with it significant changes to the Partnership laws, and other laws such as the Foundations Law, Common Reporting Standard Law and Non-Profit Incorporated Organisations Law. These changes have been included along with details of recent case law which has impacted the legal position in these areas.

In addition, this volume also covers two laws – the law relating to the Application of DIFC Laws and the Law on Application of Civil and Commercial Laws in the DIFC, which are vital to understand jurisdictional and conflict of law rules operating in this jurisdiction.
